 DRIVING LESSON AGREEMENT

1. PURPOSE OF AGREEMENT

This Agreement sets out the terms under which the Instructor will provide driving tuition to the Student in accordance with UK road traffic law and DVSA standards.

2. ELIGIBILITY TO DRIVE

The Student confirms that they:

  • Hold a valid UK provisional driving licence and ensure it is valid at all times

  • Meet the minimum legal eyesight requirements

  • Are legally permitted to take driving lessons in the UK

The Student must present their licence upon request.

3. LESSONS

  • Driving lessons will be conducted at mutually agreed dates and times.

  • Driving lessons will take place on a weekly basis, unless otherwise agreed between both parties or subject to the instructor’s availability.

  • Each lesson will be 120 minutes, unless otherwise agreed.

  • Lesson locations (pickup/drop-off) will be agreed upon in advance.

4. INTRODUCTORY OFFER

  • The introductory offer can be used only once. 

  • The student has the choice of booking a 3 hour, 5 hour or 10 hour introductory offer. Only one of these offers can be selected, they cannot be used together. 

  • The introductory offer can only be used at the beginning of your time with Liberty Learners. Thereafter, the student can choose to pay for lessons in blocks or on a lesson by lesson basis, but will no longer have access to the introductory offer prices. 

5. FEES AND PAYMENT

  • Lesson fee: as stated on Liberty Learners website under ‘price list’

  • Payment is due at the start of every lesson 

  • Accepted payment methods are bank transfer and cash 

  • Late or unpaid fees may result in suspension of lessons.

5. CANCELLATION AND RESCHEDULING

  • The Student must provide at least 48 hours’ notice to cancel or reschedule a lesson.

  • Should a student fail to cancel their lesson without sufficient notice as above, they will be charged in full for the cancelled/ missed lesson. 

  • The Instructor reserves the right to cancel or reschedule lessons due to illness, emergencies, weather conditions, or vehicle issues. Should the instructor cancel a lesson, the student will not have to pay the costs of the cancelled lesson. 

6. STUDENT RESPONSIBILITIES

The Student agrees to:

  • Arrive on time and prepared for each lesson.

  • Hold a valid provisional driver’s licence at all times during the lesson and to have this available to the instructor upon request.  

  • Follow all traffic laws and the Instructor’s directions.

  • Inform the Instructor of any medical conditions, medications, or issues that may affect driving ability. 

  • The above obligations are ongoing and the students agrees to abide by them at all times. 

7. INSTRUCTOR RESPONSIBILITIES

The Instructor agrees to:

  • Adhere to the DVSA Code of Conduct 

  • Have a full ADI license on display of their vehicle at all times whilst teaching and will produce this at the student’s request. 

  • Maintain a properly insured and roadworthy vehicle (if provided by the Instructor).

8. USE OF VEHICLE

  • If the Instructor’s vehicle is used, the Student agrees to treat the vehicle with care.

  • The Student may be held financially liable for damage caused by reckless or negligent behaviour.

9. SAFETY AND TERMINATION OF LESSON

The Instructor reserves the right to immediately terminate a lesson if:

  • The Student appears impaired (e.g., alcohol, drugs, extreme fatigue).

  • The Student behaves in a dangerous, abusive, or inappropriate manner.

  • Weather or road conditions are unsafe.

No refund will be issued for terminated lessons due to student misconduct.

10. VEHICLE USE FOR TEST 

The instructor reserves the right to withdraw their car from a test without notice should the instructor deem this necessary.

11. LIABILITY AND ASSUMPTION OF RISK

The Student understands that driving involves inherent risks. The Student agrees to participate in lessons at their own risk and releases the Instructor from liability to the extent permitted by law, except in cases of gross negligence or willful misconduct.

12. ENTIRE AGREEMENT

This Agreement represents the entire agreement between the parties and supersedes all prior discussions or agreements. Any changes must be made in writing and signed by both parties.

13. DATA PROTECTION

Personal data will be handled in accordance with the UK General Data Protection Regulation (UK GDPR) and will not be shared without consent unless legally required.
